RE: 44 Noble Street, Brooklyn — Preliminary Zoning Review (EXCERPT, pp. 2-3 of 9)

The subject property is located within an R6B district. The existing
building is a two-story museum structure with cellar, built 1968, lot area
approximately 15,000 sf, existing building footprint approximately 11,200 sf.

A museum is a community facility use (Use Group 3) permitted as-of-right
in R6B. The applicable community facility FAR is 2.0, corresponding to a
maximum zoning floor area of 30,000 sf. The existing building contains
approximately 28,400 zsf, a built FAR of approximately 1.89 — leaving
approximately 1,600 sf of unused floor area for any enlargement.

Maximum building height in R6B is 50 feet. The existing main roof has been
measured at 42'-6" (survey, Franklin Street Land Surveying, 05/08); the
gallery 3 skylight curb rises to 44'-9". Any rooftop construction wou1d
[sic] be measured against the 50-foot limit and the applicable sky
exposure plane above the street wall.

ROOFTOP PAVILION: The contemplated pavilion and sculpture terrace would
add floor area within the remaining 1,600 sf margin only if enclosed
area is strictly limited; open terrace area is treated differently from
enclosed gallery space under ZR 12-10, and the interaction of the pavilion
enclosure with the height limit and sky exposure plane requires careful
analysis before the client is advised it is feasible.
